Service Agreement

These Terms and Conditions govern your use of services provided by MCAds Media, a digital marketing agency operating in Manila, Philippines; Valencia, Spain; and serving clients in the United States. By using our website or engaging our services, you agree to be bound by these Terms and Conditions, as well as any proposals, statements of work, or agreements attached.

MCAds Media provides digital marketing services including website design and development, SEO, Google Ads and social media advertising, email marketing, analytics, and reporting. Services outside the agreed-upon scope require written approval and additional fees.

The standard minimum term of service is twelve months. After the initial term, services continue on a month-to-month basis unless terminated with at least thirty days’ written notice. All fees are billed monthly as described in the proposal, and payments are non-refundable. Advertising platform costs are the client’s responsibility and billed separately. Late payments may result in suspension or termination of services.

Clients are responsible for providing timely access to necessary content, accounts, and approvals. Failure to provide such access may delay delivery but does not constitute a breach by MCAds Media. Intellectual property rights in deliverables remain with MCAds Media until the completion of twelve months of service or the receipt of a buyout payment of $3,500 USD. MCAds Media may display completed work in portfolios or marketing materials unless otherwise agreed.

MCAds Media complies with GDPR, Spain’s LOPDGDD, the Philippine DPA, and applicable U.S. privacy laws, including CCPA/CPRA. Clients are responsible for lawful collection of any data and ensuring consent for marketing purposes. The agency acts as a data processor where applicable.

MCAds Media does not guarantee specific results such as search engine rankings, leads, or sales. The agency is not liable for indirect, consequential, or financial losses, and liability is limited to fees paid in the previous three months.

The agreement may be terminated immediately for non-payment, illegal activity, or violation of advertising policies. Upon termination, outstanding fees remain due, and intellectual property is handled according to the terms outlined above.

This agreement is governed by the laws of the State of Florida, United States, while compliance with GDPR, LOPDGDD, Philippine DPA, and CCPA/CPRA is maintained for relevant users. Disputes will first be attempted to be resolved through negotiation and, if unsuccessful, will be settled through binding arbitration in Miami-Dade County, Florida. Continued use of the website and services constitutes acceptance of any updated Terms and Conditions posted on the website.
